Term & Conditions

A completed and signed Rental Agreement is required within 24-hours to hold your reservation. The Rental Deposit is due upon receipt. Review and acceptance of the All In Experiences Ltd. Terms & Conditions which is made part of this rental agreement is required before a confirmation will be issued.  Reservations cannot be considered confirmed until the deposit has been received.  See Cancellation Policy for details on Rental Deposits.

Responsibility

All In Experiences Limited acts only as an agent for accommodations and assumes no responsibility for property loss or damage, nor liability for injury, accident, illness, loss of life, delay or irregularity which may be occasioned either by reason or defect in any vehicle or the acts of any company or persons engaged in conveying the passengers to or from their accommodations.  It is advised to take full health and travel insurance.

If for any reason beyond its control including force majeure, or the sale of the house, All In Experiences Limited is forced to cancel the booking made by the client or agent, best efforts will be made to offer another property of equivalent standing with which the client will be in agreement.  If the price of the alternative property is less, the difference will be refunded to the client, but if the price is higher, the client must pay the difference.  If however, no agreement can be reached, both parties are entitled to cancel.  All In Experiences Limited will refund to the client only the rental price paid, no other amounts will become due.

All In Experiences Limited shall not be liable for events beyond it’s control which may interfere with Renter’s occupancy of the property, including but not limited to acts of God, acts of governmental agencies, disease, fire, strikes, war, inclement weather or noise from nearby construction sites. NO REBATE OR REFUND will be offered in these circumstances. Renter fully understands that Jamaica lies in a tropical rainforest climate, and that storms can impact vacation plans, transportation and other aspects of their vacation. If there is a storm or hurricane, no refunds will be given unless local authorities order mandatory evacuations in the area containing the property. In that case, Renters will be refunded any unused portion of their payment. 

The party is solely responsible for and shall secure all personal property/belongings whilst in the property. The property owner/management company and All In Experiences Limited shall not be held responsible for any lost or stolen items. The party leader further agrees to hold harmless and indemnify the property owner/management company and All In Experiences Limited for any loss, claims, costs, expenses or actions arising from their party’s use and occupancy of the property and pool. Please also understand that there is NO lifeguard on duty and that is a major condition of this reservation that the use of the property and pool area is entirely at your own risk. Horseplay and running around is strictly prohibited. You also agree that no children/adults non-swimmers will use the pool without adequate supervision. 

The Renter shall be responsible to declare the use of the property other than for vacation purposes.  Gatherings or events must be approved prior to final payment as additional costs will apply.  Any video or audio taken on the premises other than for personal use shall not be used without prior consent of the Owner/management company.

Pets or animals are not accepted on the property. 

Smoking is not allowed inside the villa.

It is understood and agreed between all parties that the Renter and permitted occupants of the Property will abide by the following terms and conditions, and that any breach thereof will, at the Owner’s option, give the Owner the right to declare this Rental Agreement null and void, and said term ended, and the Owner shall have the right to re-enter the Property and remove or have removed all persons there from, and in such event, Renter agrees to forfeit all payments made on account of this Rental Agreement and all remedies and rights they may possess hereunder: 

(a) Unless prior arrangements have been made with Owner, no other persons shall occupy the Property at any time, including overnight guests, except those indicated in this agreement and total indicated in initial reservation inquiry. Violation of occupancy limits (or evidence of additional guests upon departure cleaning or before) can and will result in all occupants being removed from the Property, and forfeiture of Renter’s payment and damage deposit. Pre-approved additional guests will be charged a fee prior to arrival.

(b) The Renters shall not make or permit any excessive, disturbing or annoying noise in or on the grounds of the Property by himself/herself, family, agents, servants or visitors, nor permit such persons to do anything that will interfere with the rights, comforts, or conveniences of neighbors or other persons in the surrounding area.  

(c) Fire of any kind, including smoking and candle burning are PROHIBITED inside the Property at all times. Evidence of discarded smoking materials on property grounds will result in deduction from security deposit. Fireworks are prohibited on the property (including the driveway) at all times. 

(d) There shall be no use of any illegal drugs by any Renters, occupants or visitors in or on the grounds of the Property.

(e) This Agreement can only be changed by an agreement in writing by both the Renter and the Owner of the property. The Renter may not assign this Rental Agreement or sublet the Property under any circumstances.

This document, including any attachments incorporated by reference herein, constitutes the entire and sole agreement between All In Experiences Limited on behalf of the Owner of the property and Renter with respect to the subject matter hereof, and correctly sets forth the obligations of Owner and Renter to each other as of the date hereof. Any agreements or representations by Owner to Renter with respect to the subject matter of this agreement not expressly set forth herein are null and void.  

Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of Jamaica, and shall be treated as though it were executed in the Country of Jamaica. Any action relating to this Agreement shall be instituted and prosecuted only in the Country of Jamaica. Renter specifically consents to such jurisdiction and to extraterritorial service of process.

Any disputes under this agreement shall be resolved according to the rules for commercial disputes in Jamaica applying Jamaican Law. Each party shall pay their own attorney fees/costs and the country of Jamaica shall have exclusive jurisdiction over any dispute. 

Cancellation policy:

Bookings for High and Low Season

A 25% deposit applies to regular high and low season dates only. 

A 25% deposit confirms a reservation. Balance is due 60 days before travel. No refunds for cancellations are made within 60 days prior to scheduled occupancy. For cancellations made 60 or more days prior to scheduled occupancy, we will refund all deposits less a 0% administration fee.

Bookings for Christmas and New Year’s weeks

A 50% deposit confirms a reservation. Balance is due 120 days before travel. No refunds for cancellations are made within 120 days prior to scheduled occupancy. For cancellations made more than 120 days prior to scheduled occupancy, we will refund all deposits less a 10% cancellation fee.

Bookings for Thanksgiving week

A 50% deposit confirms a reservation. Balance is due 90 days before travel. No refunds for cancellations are made within 90 days prior to scheduled occupancy. For cancellations made more than 90 days or more days prior to scheduled occupancy, we will refund all deposits less a 10% cancellation fee. 

Cancellation policies vary from villa to villa.  All In Experiences Ltd.’s will work with the villa owner to issue a refund which would be subject to their terms.

All reservation changes must be made in writing.

Early departure does not warrant any refund of rental payment.

Power, water, phone, Wi-Fi and cable outages occur occasionally and are beyond our control. They will be reported as each occurs. No refunds will be given for any outages.  

Force Majeure 

The owners of the property and All In Experiences Limited accept NO responsibility or liability for any loss or damages or alterations to the terms of this booking, caused by events beyond the owners or management companies control including strikes, riots, political unrest, hostilities, war or threat of war, terrorist activity, act of God, closure of airports, adverse weather conditions, fire or flood.
